By continuing to access the Deva Co. studio or website you are agreeing to comply with and be bound by the following terms and conditions of use. Together with the privacy policy, govern Deva Co.’s relationship with you in relation to the website and studio. The term ‘you’ refers to the user or viewer of our website/studio. We reserve the right to update, change or replace any part of these Terms and conditions at any time. It is your responsibility to periodically check our website for changes. If you disagree with any part of these terms and conditions, please do not use this website.

Studio Terms & Conditions

Please read through the terms and conditions on our website thoroughly before enrolling. When enrolling as a student/client of Deva Co. Pty Ltd Shop 2, 1 Douglas St, Kirra 4225, you agree to the terms and conditions as laid out on the Deva Co. website devaco.com.au. 

  • While we endeavour to deliver all our classes and appointments on time and as advertised/scheduled, classes are subject to change or cancellation without notice. Deva Co. is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed, or cancelled for any reason. In the case of a prepaid class being cancelled you will get the credit back to use for a future class

  • Teachers are subject to change without notice.

  • Please arrive at least 5 minutes before class to get settled. We know life happens, so if you’re running late send a text and we encourage you to still come

  • Deva Co. or Co-Habitat are not responsible for the safekeeping of your belongings.

  • Bookings are to be made via our Momence app, Deva Co. website, texting 0466344652, or in the studio.

  • To book into a class you must either have credits in your account or pay at the time of booking. Class payment must be made upon booking. 

  • You agree that you have been examined by a qualified medical practitioner within the past six months and have been found by such a practitioner to be in good physical health and physically able to perform all yoga exercises.

  • The exercises and stretches in the Prenatal classes are gentle and suitable for all fitness levels. However, if you have a pre-existing problem, please check with your doctor/physiotherapist or other health care practitioner as to any limitations or exercises to avoid during the class. 

  • It is important to always work gently and slowly, and at your own pace. Please be aware of the guidelines/modifications offered in each class. Please let us know of any new condition/discomforts that may occur during your time with us.

  • You will follow all instructions given to you by Deva Co. Yoga teachers and bodyworkers you acknowledge that any failure to do so will be at your own risk and may cause injury.

  • Deva Co. is in no way liable for any injury, loss of property, or death resulting from attending our studio.

  • By booking into a class, you automatically agree to these Terms and Conditions.

Booking Changes & Cancellation Policy

Our cancellation policy is in place to ensure everyone has a chance to attend. Nobody likes additional charges, but as we have a boutique studio space numbers are limited to 10 per class. Everyday classes get fully booked, and sometimes students miss out.

  • Class cancellations can be made via the Momence/Deva Co. app, the Momence website, and at www.devaco.com.au

  • Class cancellations can be made up to 1 hour before the class start time without incurring a charge.

  • Students on unlimited passes who book into a class and fail to attend/cancel will be charged a $20 no-show fee charge.

  • Students on unlimited passes who book into a class but cancel the booking less than 1 hour of the class start time will be charged a $10 late cancel charge.

  • Students using an Intro Offer, 1, 5 & 10, Classes Pack who book into a class but fail to attend will forfeit their class.

  • Students using an Intro Offer, 1, 5 & 10 Classes Pack who book into a class but cancel the booking within 4 hours of the class start time, will forfeit their class.

  • Cancellations will not be accepted via phone, email, or social media. Please cancel via the booking system or texting 0466344652.

  • All members will receive one charge waived per calendar month.

Pricing

  • All prices are quoted in Australian Dollars ($AUD) and all transactions are processed in Australian Dollars ($AUD).

  • All prices are correct at the time of online publication. Prices are subject to change without notice.

  • Sale items are only available at a lower price during the sale period.

  • We reserve the right to amend prices and printing errors.

  • Prices may increase from time to time to reflect increases in cost and benefits.

  • All purchases are final. Deva Co. does not offer refunds, transfers, suspensions, workshops, or products for change of mind. The exception is to extend a pass/service in the case of  birth, injury, illness.

  • All passes and memberships are non-transferable.

  • Deva Co. reserves the right to pass on the cost of any additional bank fees which may incur from disputed or failed transactions regarding a student’s account.

Workshops

  • Deva Co. does not offer refunds or credits on workshops for change of mind.

  • If you cannot attend, you may transfer your workshop ticket to another person’s name by calling or emailing Deva Co. at least 24 hours before the start of the workshop.

  • Payment needs to be made upon booking.

  • Please arrive at least 15 mins before the scheduled start time of the workshop. 

  • Any no-show or absence will result in forfeiting that visit. If you do not attend a booked workshop you will be charged.

Appointments

  All appointments are prepaid at time of booking or via invoice.

  • Please arrive 10-15mins before your scheduled appointment time to get settled and go to the toilet.

  • If you are late for your appointment and arrive after the scheduled time, your appointed length may be adjusted to reflect this.

  • If you cancel within 1 hour of your appointment you may be charged a late cancelation fee of the cost of the service.

  • If you fail to show up without notice you will forfeit the prepaid appointment.

  • If you cancel with 3 hours or less notice you will definitely not be able to rebook without prepaying

Introductory Offer

  • Our Intro Offer is available only to new students.

  • Your pass will be activated from your first class booked.

  • Your Intro Offer is valid for 14 days from your first class.

  • Classes included in your Intro Offer are non-transferable and non-suspendable.

  • Students who have practiced at Deva Co.  previously are not eligible for this offer.

Class Packs

  • Our 1 Class casual pass is valid for 14 days from the date of purchase. 

  • A pack of ‘5 Classes’ is valid for 1 month from the date of purchase.

  • A pack of ‘10 Classes’ is valid for 3 months from the date of purchase.

  • A pack of ‘20 Classes’ is valid for 6 months from the date of purchase.

  • Deva Co. does not offer refunds, transfers, suspensions, or extensions on the above class packs for: change of mind, injury, illness, change of address, or any other reason; including the inability to utilise all classes prior to pack expiration. All purchases are final. However, you don’t lose your unused classes, you can add your expired classes onto a new pass.

  • Any non-cancellations, no-shows, or absences, will result in forfeiting that visit. If you do not attend a booked session or cancel within 1hours of the class start time, you will be charged for the class.

Weekly Unlimited Membership - 6 month minimum term

  • Our unlimited weekly & monthly membership agreements are for a minimum of 26 monthly debits of $39 or 6 monthly debits of $140. 

  • Memberships are paid monthly in advance for the following month of practice.

  • Deva Co. does not offer refunds, for: change of mind, injury, illness, change of address, or any other reason; including the inability to utilise all classes prior to membership expiration. All purchases are final.

  • For membership pauses, we require at least 7 days notice prior to your next billing date and the suspension is possible for a minimum of 2 weeks and possible in 1-week blocks thereafter. 

  • You may pause your membership for up to 12 weeks at a time and for a maximum of 12 weeks per calendar year.

  • Requests to pause memberships must be made in writing to connect@devaco.com.au Requests will not be accepted by any other means.

  • Memberships exclude attendance at guest teachers’ classes and workshops.

  • All members will receive one charge waived per calendar month.

  • Memberships cannot be shared. 

  • It is your responsibility to ensure there are sufficient funds available to cover the fortnightly or monthly auto-debit. Your payment will attempt to be debited every day for 7 days after the failed payment and you will be unable to book or attend classes until your payment has been settled.

  • Deva Co. is not responsible for additional bank fees that you may incur from your bank. Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.

  • All account debts must be settled before cancellation of membership can be finalised, this includes all late cancellation and no show fees incurred.

  • A membership cancellation charge is payable if you chose to cancel your membership before the end of the minimum term. It is an amount equal to 50% of the balance of your membership fees for the remainder of the minimum term or a sum equal to 30 days of Membership Fees (whatever is the higher).

  • Deva Co. is not responsible if members cannot use our services or facilities because of an event caused by a natural force such as COVID-19 restrictions, extreme weather, or something similar beyond our reasonable control. If this continues for more than 30 days, then either you or we may cancel your membership immediately by written notice. 

  • To cancel your membership, We require at least 7 days notice prior to your next billing date. 

Monthly Membership - No minimum term

  • Monthly memberships - No minimum term, are a rolling contract and will continue to debit $175 monthly until cancellation is requested by you in writing here.

  • Memberships are paid monthly in advance for the following month of practice.

  • Deva Co. does not offer refunds, for: change of mind, injury, illness, change of address, or any other reason; including the inability to utilise all classes prior to membership expiration. All purchases are final.

Gift Cards

  • Gift Cards can be used for yoga classes or appointments at Deva Co.

  • Gift Cards are not redeemable for cash.

  • Valid for 3 years from the date of first use.

  • Gift Cards are not transferable.

  • We accept no responsibility if a card is lost, stolen, destroyed, or used without your permission.

  • Gift Cards may be purchased online here.
